In the currency of globalization, IPR regime is juxtaposing sundry policy issues such as health, environment, trade, electronic commerce etc. It has now turned out to be indispensable that the policy makers need to possess the required expertise and equipped with the skills and competence to discharge their functions far more effectively. The move from Paris Convention to TRIPs and from TRIPs to TRIPs Plus and now form TRIPs Plus to TRIPs Plus Plus shows the paradigm shift at the international flat in the name of effective protection of intellectual property. However, it is often being said that the TRIPs Agreement was outcome of mercantilist ideology and sometime dubbed as a politics of “haves” (Developed Nations) against the “have-nots” (Third World Countries).

Rousseau also inform us, “laws are invariably useful to those who own property and harmful to those who do not”. Thus, the Developed Nations naturally sprout forth and cannot be prevent from manipulating IPR Regime for their private advantage. The universal spirit of the TRIPs provisions is always to favour the strong against weak, and the one who has against the one who has nothing. This inconvenience is inevitable, and it is without exception. The Third World Countries initially delights in the Multinational Agreement believing it to be a league for mutual relief and benefit; but they soon discovers that it is a swindle designed to benefit the Developed Nations.

In behaving this way, the Developed Nations disclose the darkest truth about its nature. Whenever they can, they will avoid an equal sharing of burdens. If they will engross sweet pleasures and gratifications for themselves and their immediate, circle and offload thankless task and noxious living conditions upon Third World Countries.

It is in this backdrop that NUSRL, Ranchi has taken this initiative to organize First - NUSRL IPR ESSAY COMPETITION - 2012 and endeavours to encourage and promote creative, logical thinking and knowledge about legal understanding and research amongst students.

NUSRL RANCHI: National University of Study and Research in Law, Ranchi has been established by the State Legislature of Jharkhand by passing the National University of Study and Research in Law, Ranchi Act 2010 (Jharkhand Assembly Act No. 4 of 2010). The First NUSRL Annual IPR Essay Competition – 2012 seeks to address the thorny issues in the fields of Intellectual Property Law. The main objective of the Competition is to initiate an intellectual churning process for realizing and contextualizing the Third World Approach to Intellectual Property Law Regime. It endeavours to encourage and promote creative, logical thinking and knowledge about legal understanding and research amongst IPR Persons.

THEME FOR THE ESSAY WRITING COMPETITION: IPR Implications vis-à-vis Developing Countries

ELIGIBILITY: Students of all streams, Legal/Corporate Professionals and Researchers.

SUBMISSION GUIDELINES;

  • Essays must not be longer than 5000 words. It must be accompanied by an abstract of not more than 500 words. The abstract will be used by the jury for pre-selection.
  • All submissions must be typewritten in Times New Roman, 12 Font Size, 1.5 Line Spacing and Headings/Titles must be in Capital. Footnotes should be in Times New Roman Font size 10. The Footnotes used should follow a uniform & complete system of citation.
  • Quotes and references must be clearly marked throughout the essay (preferably in italics) and properly cited. Any method of citation can be followed but is required to be consistent throughout the text.
  • Submissions can only be made both in Soft Copy & Hard Copy in English. All soft submissions are to be electronically mailed.
  • Entries will be accepted only in MS WORD format.
  • The identity of the author is not allowed to be indicated anywhere in the text. All submissions will be blind reviewed. References to specific individuals, firms, or schools, which might reveal the author's identity are strongly discouraged and shall be liable to be disqualified.
  • Entries should be accompanied by a cover page with the author/s name, mailing address, telephone, fax numbers, and e-mail address; name, address of the institution where the student is enrolled, year of study.
  • Word count is required to be mentioned on the cover page.

TERMS AND CONDITIONS

  • Any entry after the prescribed date shall not be entertained.
  • Participant should not submit more than one entry.
  • Joint Authorship is allowed, but it should not be exceeding two participants.
  • All submissions must be original. No previously published material will be accepted. Any form of plagiarism will result in automatic disqualification.
  • All essays received in the competition become the property of NUSRL IPR Essay Competition, which reserves the right to publish the essays in any form-electronic or print.
  • The contestants by entering in the contest give NUSRL IPR Essay Competition the right to publicise the winning entries without any royalty or compensation.
  • The contestants by entering in the contest agree to indemnify NUSRL All India Essay Competition from and against all claims, suits, and damages based on any claim of copyright infringement or plagiarism or unauthorized use.
  • Neither the Convenor NUSRL IPR Essay Competition nor the committee will be responsible for any condition beyond its control that may cause the contest to be interrupted.
  • The decision of the Jury shall be final and will not be subject to an appeal.
  • 1st NUSRL All India Essay Competition shall take no responsibility in any matter arising out of any dispute as regards the authenticity of the submitted work.
